Overview

As a result of regulations adopted by the Cannabis Control Board individuals and corporations—including nonprofit organizations—may be eligible applicants for a Conditional Adult-Use Retail Dispensary license. The Conditional Adult-Use Retail Dispensary license authorizes the license holder to acquire, possess, sell, and deliver cannabis from a retail dispensary to consumers who are 21 and older.

To be eligible as an individual or as a taxable entity, applicants must meet all of the following requirements:

  • A significant presence in New York State

  • Majority of the retail dispensary business is owned and controlled by a justice involved person (or people) with qualifying business ownership experience

  • All applicants must be 21 years of age, including any/all board members

  • All partners and members of the partnership or LLC must be U.S. citizens or permanent residents, or all officers and the majority, in terms of number, not ownership shares, of directors of a corporation must be U.S. citizens

To be eligible as a nonprofit organization, applicants must meet all of the following requirements:

  • A significant presence in New York State

  • The nonprofit organization is recognized as an entity pursuant to section 501(c)(3) of the Internal Revenue Code

  • The nonprofit organization intentionally current or formerly incarcerated individuals, including justice involved individuals and communities with historically high rates of arrest, conviction, incarceration or other indicators of law enforcement activity for marihuana-related offenses

  • The nonprofit organization has a history of creating vocational opportunities for current or formerly incarcerated individuals, including justice involved individuals

  • The nonprofit organization has at least five full-time employees

  • The nonprofit organization has operated and managed a profitable social enterprise for two or more years

  • All applicants must be 21 years of age, including all board members

  • All partners and members of the entity that will operate the dispensary must be U.S. citizens or permanent residents, or all officers and the majority, in terms of number, not ownership shares, of directors of a corporation must be U.S. citizens

  • Applicants eligible under the CAURD qualifying nonprofit criteria will not be eligible to receive a dispensary location provided for by the Fund. Applicants eligible under the CAURD qualifying nonprofit criteria will be required to find their own conditional retail dispensary location if selected for a license by the Board. The conditional retail dispensary location will be subject to review and approval by the Office. Such applicants do not need to have this location identified at the time of initial CAURD application.


Justice Involved means someone who has been convicted of a marihuana-related offense in New York State before 3/31/2021 or is the spouse, child, legal guardian, or dependent of someone who has been convicted of a marihuana-related offense in NYS before 3/31/2021. Individuals who can provide evidence they (or their spouse, child, legal guardian, or dependent) were arrested for a marihuana-related offense are considered justice involved if they were ultimately convicted of a lesser offense, such as non-drug offense, violation, or misdemeanor.

Qualifying Business Ownership Experience means the justice involved person must also have previous or current experience owning and controlling at least 10% of business for at least two years. They must also show that business was profitable during that two-year period.

Conditional Adult-Use Retail Dispensary licensees shall have the same authorizations and conditions as an adult-use retail dispensary as defined by the Cannabis Law and regulations promulgated by the Cannabis Control Board. Failure to comply with program guidance or any rules or regulations issued by the Office of Cannabis Management or Cannabis Control Board may result in the license being deemed surrendered.

  1. Applicant Primary Contact Information

  2. Applicant ownership and financial disclosure information including submission of organizational structure documents, organizational charts, capitalization tables and ownership structures, and disclosures of any sources or proposed sources of capital

  3. Documentation proving the applicant meets eligibility criteria for CAURD, including documentation of the justice-involved individuals address at time of such individual’s arrest or conviction

  4. Applicant attestation

  5. Submission of non-refundable License and Application Fee of $2,000
